The climate is often harmed by environmental crimes, which in turn have significant financial drivers. The link between environmental crime and financial crimes has been recognized by the United Nations, the European Union and the US Treasury. But the connection with climate has been largely unexplored. This gap limits the role that money laundering and related proceeds of crime laws play in addressing unlawful activities that drive climate change. It also creates potential blind spots for corporate and financial actors in terms of their risk exposure. This panel explores the nexus between financial crimes laws, environmental crime, and climate change, considering some of the questions that lawyers and finance professionals face: ● How might anti money laundering and counter illicit finance laws be useful in addressing climate harms? ● Which of the traditional “environmental crimes” have significant climate impacts, and to what extent may financial crimes laws apply to other criminal activity such as illegal deforestation and the commercial activity that is predicated on it? ● What does the application of financial crimes laws to climate harm look like in practice? ● Where do we go from here?
